Rome, 28 December 2016 – After 75 days of negotiations, held in accordance with the timing and procedures set out by the law – during which all the trade union organizations present reiterated their line of absolute refusal to discuss the proposals advanced by AlmavivA Contact on their merits, albeit without offering any alternative proposals – the collective dismissal procedure finally ended on 22 December, with an agreement brokered by the Government.

The trade union organizations of the Rome office, the only unions authorized to sign, unanimously refused to add their signatures to the agreement, officially declaring that they were adhering to the workers’ mandate. The unions of the Naples office, instead, signed the agreement.

We learn today, following certain very surprising trade union statements, that an attempt is under way to scrap everything, declaring that the totality of the Rome-based unions acted against the will of the majority of the workers. As if the almost three months of negotiations were simply a game by those who now wish to remove the responsibility to act on the basis of specific worker representation laws.

In line with the repeated declarations and taking note of the unitary statement by the trade union organizations, the Rome operations center was finally closed down on 22 December and ceased all operations.

Today, only those who are unaware of the rules and procedures or who think that they can simply ignore them can think of the possibility of re-opening a process that has been formally closed with the signing of an agreement, by the parties involved, jointly with the competent representatives of the Ministry for Economic Development and the Ministry of Labor. The law, in fact, is very clear on the matter if, after 75 days, the negotiations fail without a deal being agreed to, then there’s no going back, no rethinking the decision taken, and no changes or additions can be made to the agreement.

There can be no possibility of entering into supplementary negotiations, in contrast with the mandate granted to the unions, as declared, it would simply be technically and legally impossible because it would invalidate the entire process that ended with the Government’s intermediation.
